Chapter 13 is often filed to protect non-exempt property, stop a foreclosure on your house, save your vehicle, stop a wage garnishment or deal with IRS tax debt. Chapter 13 is a repayment case where you make monthly payments under a repayment plan to pay some or all of the debt you owe over 3 to 5 years. Monthly payments are based on the amount you can afford. Chapter 13 includes all unsecured debts like credit cards, medical bills, and monies owed after repossession. Chapter 13 also includes secured debts owed on a vehicle, past-due house payments, furniture and the like. Chapter 13 is designed to allow you to deal with unsecured and secured debts to keep and pay off property that is collateral for a loan. You are protected from creditors while you are in the case. At the end of the Chapter 13 case, you should receive a discharge order from the Court.
